[N]ot only is the use of torture illegal, but information derived through its use cannot be used in U.S. courts. To get around the first inconvenience, Bush s lawyers arranged for torture to be redefined, and, to overcome the second, the Bush administration initially brought the military commissions out of retirement with the intention that the prohibition on torture could be ignored. ... The Obama administration?s revival of the commissions faced profound criticism from those who had served in Bush s military commissions, from Lt. Col. Darrel Vandeveld and Maj. David Frakt, for example, but the administration pressed on regardless...

Defense lawyers in the Sept. 11 case at Guantanamo are seeking the testimony of former President George W. Bush and President Barack Obama in a motion to dismiss charges, according to a legal motion released Wednesday. Lawyers for three of the five defendants charged with planning and helping carry out the attacks say the charges should be dismissed because Bush, Obama and other top officials have made many statements that could influence potential jurors in their eventual trial before a special tribunal known as a military commission, according to the motion...

9/11 defense attorneys denounce Guantanamo court system as 'rigged,' 'unjust'
''These men have endured years of inhumane treatment and torture'' that will ''infect every aspect of this military commission tribunal,'' attorney James Connell III warned. The Navy s top lawyer on Sept. 11, 2001, declared Sunday, ''I am convinced more than ever that this belongs in federal court.''

Guantanamo Scandal: The 40 Prisoners Still Held, but Cleared for Release at Least Five Years Ago
Andy Worthington, Andy Worthington's Blog: ''One of the greatest injustices at Guantanamo is that, of the 169 prisoners still held, over half, 87 in total, were cleared for release by President Obama s interagency Guantanamo Review Task Force. The Task Force involved around 60 career officials from various government departments and the intelligence agencies, who spent the first year of the Obama Presidency reviewing the cases of all the remaining prisoners in Guantanamo, to decide whether they should be tried, released, or, in some cases, held indefinitely without charge or trial.''

Guantanamo Attorney: Supreme Court s Refusal to Hear Habeas Cases Invalidates Landmark 2008 Ruling
Jason Leopold, Truthout: ''Now what? That s the question attorneys who represent Guantanamo detainees are asking after the Supreme Court on Monday refused to consider the appeals of seven prisoners, who petitioned the justices to review decisions in their habeas cases made by a conservative appeals court. The decision flies in the face of the court s 2008 landmark ruling in Boumediene v. Bush, which granted detainees a 'meaningful opportunity' to challenge their detentions.''

Hope Dies at Guantanamo
Marjorie Cohn, The Jurist: ''Of the 800 men and boys held at Guantanamo since 2002, 169 remain. Of those prisoners, 87 have had their release approved by military review boards established during the Bush administration, and later by the Guantanamo Review Task Force established by President Obama in 2009. Yet they continue to languish in the prison camp.''

Truthout FOIA Exposes Forceful Drugging of Detainees
Alyona Minkovski, The Alyona Show: ''For years, current and former detainees from Guantanamo and other US military sites, as well as their attorneys, have argued that they were forcibly given pills and injected with unknown medications.... And now, thanks to a Freedom of Information Act Request filed by Truthout, a report from the DOD s deputy inspector general has confirmed much of it. Alyona Minkovsky talks to Jason Leopold, lead investigative reporter for Truthout.org about what the FOIA exposed.''
